By creating an account or using the NestVault service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.
These Terms constitute a legally binding agreement between you and NestVault LLC, a California limited liability company ("NestVault," "we," "us," or "our").
NESTVAULT IS AN ORGANIZATIONAL AND DOCUMENT STORAGE TOOL. IT IS NOT A FINANCIAL ADVISOR, INVESTMENT ADVISOR, LEGAL ADVISOR, ESTATE PLANNER, INSURANCE BROKER, OR ANY OTHER PROFESSIONAL SERVICE.
Nothing in the Service or communications from NestVault constitutes financial, legal, tax, or other professional advice. NestVault does not verify the accuracy of information you enter into your vault. NestVault does not advise you on estate planning, beneficiary designations, insurance coverage, investment decisions, or any other matter.
You should consult qualified professionals — including attorneys, financial advisors, and insurance professionals — for advice specific to your situation. NestVault provides organization and delivery; all decisions about what to include, how to structure your estate, and what beneficiaries to name are entirely yours.
You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and have the legal capacity to enter into these Terms.

You may not share your account with others. Each subscription covers one individual vault holder.
NestVault offers the following subscription plans:

Prices are subject to change with 60 days' notice to existing subscribers. Your rate will not change during the current billing period.
All payments are processed by Stripe, Inc. By providing payment information, you authorize NestVault to charge your payment method for applicable setup fees and annual subscription renewals. You agree to Stripe's terms of service, available at stripe.com/terms.
Refund policy: Setup fees are non-refundable. Annual subscription fees are non-refundable after 30 days from payment. Within the first 30 days, contact hello@mynestvault.com for a refund.
NestVault provides:
The 48-hour vault release commitment begins from the time all required verification documents (death certificate and beneficiary government ID) are received and confirmed complete. NestVault is not responsible for delays caused by incomplete or fraudulent submissions.
A vault release will only be initiated upon receipt of all of the following:
NestVault manually reviews all release requests. We reserve the right to request additional verification and to delay or deny a release if we suspect fraud, identity issues, or other irregularities.
Upon successful verification, we will generate a secure, read-only link to vault contents. This link expires 30 days after issuance and cannot be reissued after expiration without a new verification process.
If multiple parties claim entitlement to vault access, NestVault will place the release on hold and may require a court order to proceed.
NestVault stores what you put in it. We make no representations about the completeness or accuracy of vault contents. We are not responsible for information that was not entered, was entered incorrectly, or became outdated.
You own all information you enter into your vault. By using the Service, you grant NestVault a limited license to store, process, and transmit your content solely for the purpose of providing the Service.
You are responsible for the accuracy of information in your vault. NestVault does not verify, audit, or validate vault contents.

You may cancel your subscription at any time through your account settings or by contacting hello@mynestvault.com.
Upon cancellation:
We recommend exporting or printing your vault summary before cancelling.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
NESTVAULT DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; THAT THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS; OR THAT DATA WILL NOT BE LOST (THOUGH WE TAKE EXTENSIVE PRECAUTIONS).
THE FOREGOING DOES NOT AFFECT WARRANTIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NESTVAULT'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF:
(a) THE TOTAL AMOUNT YOU PAID TO NESTVAULT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED DOLLARS ($100).
IN NO EVENT SHALL NESTVAULT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
This limitation applies to all claims regardless of the theory of liability, including breach of contract, tort, negligence, strict liability, or any other legal or equitable theory.
You agree to indemnify and hold harmless NestVault and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the rules of the American Arbitration Association (AAA), rather than in court, except that either party may bring individual claims in small claims court.
YOU AND NESTVAULT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. If a court finds this waiver unenforceable, the arbitration agreement shall not apply to that claim.
You may opt out of the arbitration agreement by emailing hello@mynestvault.com within 30 days of creating your account with the subject "Arbitration Opt-Out." If you opt out, you and NestVault agree to resolve disputes in state or federal courts located in Orange County, California.
Notwithstanding the above, either party may seek injunctive relief in court to prevent irreparable harm while arbitration proceeds.
These Terms are governed by the laws of the State of California, without regard to its conflict of law provisions. For disputes not subject to arbitration, you consent to exclusive jurisdiction in state and federal courts located in Orange County, California.
We may modify these Terms at any time. If we make material changes, we will notify you by email at least 30 days before the new Terms take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms. If you do not agree, cancel your subscription before the effective date.
